Most people have heard of probate and estate administration, but they might not fully understand what these terms mean. Simply put, it's the legal process that takes place after someone passes away, involving the validation of their Will (if one exists), identifying and valuing their assets and debts, paying off any liabilities, and finally distributing the remaining assets to the beneficiaries.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

\n\t\t\t\t\t\tNot always.<\/b>

\nWhether probate is required depends on the nature and value of the assets involved.\nFor example, if someone owned a property in their sole name, a Grant of Probate<\/b> (or Letters of Administration if there\u2019s no Will) is usually needed to sell or transfer that property.

\nHowever, some assets don\u2019t require probate, such as:

\n\u2022\tProperty or bank accounts held jointly (these often pass automatically to the surviving owner).

\n\u2022\tAssets with a named beneficiary<\/b>, like some life insurance policies or pensions.\nIf you're unsure whether probate is needed, we can help you assess the situation and work out what to do next. If you are an executor, you will need the correct information about inheritance tax allowances, otherwise you may pay IHT when you don\u2019t need to or even underpay it. As an executor you are legally liable<\/b> for this, so it is important to get it right.

\n\u2022\tIf the Will includes a Trust<\/b>, it\u2019s important to handle it with care. Trusts require special attention and the right advice \u2014 without it, the Trust may not work as intended, and the assets it was meant to protect could be at risk.
